Tesla Faces Recall Risk as NHTSA Demands Internal “Radar Saves Us” Document in FSD Crash Probe

Federal safety regulators have escalated their investigation of Tesla’s Full Self-Driving system to its most serious pre-recall stage, demanding that the company hand over an internal document titled “Radar Saves Us” — a file that Tesla itself apparently created to analyze how radar detects dangerous situations that cameras alone miss.

The National Highway Traffic Safety Administration issued the request on July 2, 2026, as part of Engineering Analysis EA26002, an investigation covering approximately 3.2 million Tesla vehicles that have ever run FSD in the United States. Tesla’s deadline to respond is August 12, 2026.

What Is an Engineering Analysis?

An Engineering Analysis is NHTSA’s highest-intensity investigative phase — the final step before the agency either closes a case or formally pushes for a recall. EA26002 was upgraded from a Preliminary Evaluation back in March 2026, after investigators determined the scope and severity of the reported failures warranted deeper scrutiny.

The investigation is tied to nine crashes in reduced-visibility conditions: sun glare, fog, and airborne dust. Of those nine, one resulted in a fatality and one in serious injuries. In every case, the environmental conditions degraded the camera sensors that FSD relies on entirely after Tesla removed radar from its vehicles in 2021.

The “Radar Saves Us” Document

The document’s name was disclosed publicly for the first time inside NHTSA’s 24-part information demand letter to Tesla. According to NHTSA’s characterization, “Radar Saves Us” appears to contain Tesla’s own technical analysis demonstrating that radar — or a radar-fused-with-vision architecture — detects scenarios that a camera-only system cannot.

Tesla handed the document to NHTSA privately during the earlier phase of the investigation, and the agency is now formally pulling it into the record — a move that signals the agency believes its contents are directly relevant to the nine crashes under review.

The timing is significant: the nine crashes under investigation all involve the exact failure mode that radar was theoretically designed to catch. By naming the document in a federal information request, NHTSA is effectively arguing that Tesla may have known of this gap before or during the period covered by the crashes.

15 Marketing Claims Under Scrutiny

Alongside the document demand, NHTSA asked Tesla to confirm whether 15 specific marketing statements — made by Tesla or by Elon Musk — imply capabilities that FSD does not currently possess.

The agency also asked Tesla to explain why it downgraded the visual warning color for FSD system degradation from red to yellow, and why it removed audible alerts that previously warned drivers when the system detected reduced operational capability.

Penalties and Stakes

Tesla has until August 12, 2026 to respond to the full 24-part information demand. Failure to respond carries potential civil penalties of up to $27,874 per day, capped at approximately $139 million under current federal statute.

This investigation runs separately from NHTSA’s other open Tesla probes, including a preliminary evaluation opened July 31 covering 1.2 million vehicles for suspension failures in 2018–2020 Model 3 and 2021–2023 Model Y vehicles.

The Bottom Line for Tesla Owners

EA26002 does not yet constitute a recall. An Engineering Analysis can be resolved without one — NHTSA sometimes closes investigations after reviewing manufacturer responses. But the agency’s decision to name an internal Tesla document by title, and to ask Tesla to either validate or explain away 15 specific marketing claims, suggests investigators believe they have located meaningful evidence of a gap between what Tesla marketed and what FSD could safely deliver in poor visibility.

For drivers currently running FSD, the practical guidance has not changed: the system requires active supervision and drivers should take manual control whenever visibility is reduced by sun glare, fog, or dust. The August 12 response deadline will be a key date to watch.
